Terms and Conditions
These terms and conditions apply to all orders placed with De Zzign Trading CC (Registration Number: CK2004/025121/23) trading as Giftique ZA (“Giftique ZA”). By placing an order, you confirm that you have read and agree to these terms and conditions.
1. Wholesale Orders
Wholesale and trade orders are subject to minimum order quantities as specified per product. Prices are quoted exclusive of VAT unless otherwise stated. Giftique ZA reserves the right to update pricing without prior notice.
Unless otherwise stated, quotations are valid for 30 days from the date of issue.
2. Corporate Gifting Orders
Corporate gifting orders from the existing range are subject to the same terms and conditions. Bespoke and custom orders are governed by a separate project agreement confirmed in writing prior to production commencing.
3. Bespoke and Branded Work
All bespoke orders require a written brief, approval of a design proof, and a non-refundable deposit before production begins. The deposit amount will be confirmed at the time of quotation.
Giftique ZA retains the right to photograph completed work and use such photographs for marketing, portfolio, website and social media purposes unless otherwise agreed in writing prior to production.
4. Payment Terms
Payment is due in full before goods are dispatched unless a credit arrangement has been confirmed in writing. EFT payments must reflect in the Giftique ZA account before dispatch. Proof of payment must be emailed to info@giftique.co.za.
Giftique ZA does not accept responsibility for delays caused by late payment.
5. Delivery
Giftique ZA delivers nationwide via courier. Delivery costs are for the account of the buyer unless otherwise agreed. Delivery timeframes are estimates only. Giftique ZA is not liable for delays caused by third-party courier services.
Risk of loss passes to the buyer upon dispatch.
Please inspect all goods on delivery and report any visible damage within 24 hours.
6. Lead Times
We manufacture on order. Lead times depend on quantity and stock availability. While many products are manufactured to order, limited stock is held on selected items. Please enquire regarding availability when placing your order.
7. Product Variation
Many Giftique ZA products are hand-painted, hand-finished or otherwise individually crafted. As a result, natural variation in colour, shading, brush technique, grain and finish may occur between items, batches and photographs shown in marketing materials. Such variation is inherent to the handmade nature of the product and is not considered a fault or defect.
8. Returns and Exchanges
Giftique ZA does not accept returns on change-of-mind purchases.
Faulty or incorrectly supplied goods must be reported within 5 business days of receipt, with photographs provided. Confirmed faulty goods will be replaced or credited at Giftique ZA’s discretion.
Any shortages, incorrect items or delivery discrepancies must be reported in writing within 5 business days of receipt of goods. Claims submitted after this period may not be considered.
Bespoke and customised items cannot be returned once production has commenced.
9. Intellectual Property
All product designs, branding, photography and content on the Giftique ZA website, catalogue and marketing materials remain the intellectual property of Giftique ZA.
Stockists are granted permission to use Giftique ZA product photography solely for the purpose of promoting and selling genuine Giftique ZA and Zafric® products.
Any watermarks, logos, branding or copyright notices appearing on such images may not be removed, altered, obscured or cropped out without the prior written consent of Giftique ZA.
Reproduction, copying, modification or distribution of Giftique ZA designs, photography or content for any other purpose is prohibited without written permission.
10. Zafric® Trademark and Product Branding
Zafric® is a registered trademark owned by De Zzign Trading CC t/a Giftique ZA.
All products supplied by Giftique ZA are sold as Zafric® branded products and may include Zafric® branding by means of engraving, tags, labels, packaging inserts, stickers or other branding elements at Giftique ZA’s discretion.
The Zafric® brand forms an integral part of the product and may not be removed, omitted, concealed, altered or replaced without the prior written consent of Giftique ZA.
By placing an order, the buyer acknowledges and accepts that products will be supplied with Zafric® branding.
11. Stockist Responsibilities
Stockists may not represent Giftique ZA products as their own designs or manufacture.
Any display stands, merchandising units, point-of-sale materials, signage or promotional materials supplied by Giftique ZA and bearing Giftique ZA or Zafric® branding are intended solely for the display and promotion of Giftique ZA and Zafric® products.
Such branded display materials may not be used to display, market or sell products from other brands, manufacturers or suppliers without the prior written consent of Giftique ZA.
Accounts found to be in breach of these terms may be suspended or terminated at Giftique ZA’s discretion.
Giftique ZA reserves the right to refuse, suspend or cancel orders from customers who are in breach of these terms, have overdue accounts, or whose conduct may adversely affect the Giftique ZA or Zafric® brands.
12. Privacy
Giftique ZA collects and stores personal information for order processing and account management purposes only.
Your information will not be shared with third parties except where required for delivery or where required by law.
13. Limitation of Liability
To the maximum extent permitted by law, Giftique ZA’s liability arising from any order shall be limited to the value of the goods supplied.
Giftique ZA shall not be liable for any indirect, consequential or economic loss arising from the use or supply of its products.
14. Force Majeure
Giftique ZA shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to power failures, load shedding, strikes, supplier shortages, natural disasters, acts of God, civil unrest or transport disruptions.
15. Design and Sampling
The following terms apply to all design and sampling work undertaken by Giftique ZA:
- Initial product recommendations from our existing range are provided free of charge.
- Custom concepts, extensive design work and sample development will incur a design fee. The fee will be confirmed in writing before work commences.
- Design fees are credited against qualifying production orders where applicable.
- All concepts, artwork, mock-ups and product designs created by Giftique ZA remain the intellectual property of De Zzign Trading CC t/a Giftique ZA at all times. Design fees, where applicable, are charged for the time and skill involved in the design process and do not constitute a transfer of intellectual property rights.
- Unauthorised reproduction, copying or use of Giftique ZA concepts or designs is prohibited.
- Minimum order quantities (MOQs) apply to all production orders. MOQs will be confirmed at the time of quotation.
16. Governing Law
These terms and conditions are governed by the laws of the Republic of South Africa.
Any disputes arising from these terms and conditions shall be subject to the jurisdiction of the South African courts.
